JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-09-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Petitioners and 6 others are named in the first information report with accusation that they, mercilessly, assaulted the deceased but learned counsel for the petitioners drew my attention towards the Photostat copy of postmortem report of the deceased (Annexure-3 to this petition) and submits that only one injury was found on the person of the deceased. It was further contended by him that as a matter of fact, on the alleged date of occurrence, it was prosecution party, who assaulted petitioners and others for which; petitioner No. 1 lodged Motipur P.S. Case No. 123 of 2015.

Patna High Court Cr.Misc. No.38145 of 2015 (2) dt.08-09-2015 2/2 Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Motipur P.S. Case No. 124 of 2015 to the satisfaction of learned Sub Divisional Judicial Magistrate, West, Muzaffarpur.
