JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 08-05-2023 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Nawada Nagar P.S. Case No. 218 of 2019 registered for the offences punishable under Sections 363, 366A/34 of the Indian Penal Code.

As per FIR, all the FIR named accused including the petitioner abducted the minor daughter of the informant when she went to appear in the matriculation examination. Learned counsel for the petitioner submitted that petitioner has falsely been implicated in this case. It is further submitted that there is general and omnibus allegation against the petitioner and specific overt act has been levelled against co-accused Md. Neyaz. It is further submitted that similarly

Patna High Court CR. MISC. No.6801 of 2023(2) dt.08-05-2023 2/2 situated co-accused has already been granted bail in Cr. Misc. No.12606 of 2021 vide order dated 28.01.2022. It is further submitted that petitioner has clean antecedent as stated in para-3 of this application.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the above named petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 25,000/- ( twenty five thousand) each with two sureties of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Nawada in Nawada P.S. Case No. 218 of 2019 subject to condition as laid down under Section 438(2) of the Cr.P.C.
