The petitioner is languishing in jail custody since 1.5.2015 in connection with Raniganj P.S. Case no. 88 of 2015 (G.R. no. 1074 of 2015) for the offences alleged under Sections 457, 380 and 411 of the Indian Penal Code.
The prosecution case is that on 1.5.2015 at about 3 A.M. while the informant was sleeping, a theft was committed in his house. On raising alarm, the person, who committed theft, was caught hold of with the help of the villagers and later on, the theft article, a box, was recovered.
It has been submitted by the learned counsel for the petitioner that he is innocent and has committed no offence. It has further been submitted that he is residing 60 kilometers away from the house of the petitioner and, as such, he could not have been implicated in the present case. He has further submitted that there was no signature on the seizure list.
Under such circumstances, let petitioner, namely, Sonu Chauhan, be enlarged on bail on furnishing bail bond of
Patna High Court Cr.Misc. No.37112 of 2015 (2) dt.31-08-2015 Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria, in connection with Raniganj P. S. Case no. 88 of 2015.
It may be noted that since the petitioner is an accused in other cases of similar nature, in future if he indulges in an offence of similar nature, learned court below will be at liberty to cancel his bail bond.
