JUSTICE PURNENDU SINGH ORAL ORDER 11-07-2023 Heard Mr. Braj Kishore Singh, learned counsel appearing on behalf of the petitioner and Mr. Prabhakar Jha and Mr. Amitesh Jha, learned counsel appearing on behalf of the respondents.

2. Learned counsel appearing on behalf of the petitioner submits that he has been instructed by the petitioner that he seeks to file detail representation. However, the authorities are at the same time responsible to make payment of entire amount on account of G.P.F. forthwith as well as Contributory Provident Fund.

3. In case, G.P.F. is not applicable to the petitioner, then in that case forthwith payment of Contributory Provident Fund must be paid to the petitioner within a period of two weeks.

4. As desired by the petitioner, he may file a detail representation before the Chairman of the Uttar Bihar Gramin Bank, Muzaffarpur.

5. The Chairman of the Uttar Bihar Gramin Bank, Muzaffarpur must dispose of the representation of the petitioner, with respect to the entitlement of the petitioner to receive leave encashment and group insurance, in light of the regulation of the Bank in accordance with law within a period of six weeks from the date of filing of detail representation.

6. The petitioner, if so advised, may avail appropriate remedy against the order contained in Annexure-5 and avail appropriate remedy if any proceeding is pending against him. The petitioner must cooperate in the proceeding.

7. The authority concerned must pass an appropriate order, if any proceeding is pending against the petitioner within the aforesaid period.

8. With the above direction and observation the writ petition stands disposed of.
