JUSTICE MOHIT KUMAR SHAH) 23-02-2026 The present writ petition has been filed for release of Mahindra TUV 300 bearing Registration No. BR 31PA 6293, Chassis No. MAINA2VZXJ6C39191, Engine No. VZJ6C32442, which has been seized in connection with Patna (Byepass) P.S. Case No. 43 of 2024 dated 01.02.2024 registered under Sections 328, 379, 420 and 34 of the Indian Penal Code.

2. The learned counsel for the petitioner submits that the petitioner is the owner of the aforesaid vehicle in question and he has got no complicity in the alleged occurrence.

At the outset, the learned counsel for the petitioner submits that the petitioner has filed a petition under Section 451 of the Code of Criminal Procedure, 1973 before the learned court of Additional Chief Judicial Magistrate-VI, Patna City, however the same is still pending, hence the learned trial court be directed to dispose of the same within a stipulated time frame.

4. Without going into the merits of the case, we deem it fit and proper to direct the learned court of Additional Chief Judicial Magistrate-VI, Patna City to dispose of the aforesaid petition filed by the petitioner under Section 451 of the Code of Criminal Procedure, 1973, preferably within a period of four weeks from the date of receipt/production of a copy of this order.

5. Accordingly, the present writ petition stands disposed of.
