JUSTICE ASHUTOSH KUMAR) Date : 23-03-2022 Heard Mr. Binay Kumar, learned advocate for the petitioner and Mr. Upendra Pratap Singh for the State. The license of the petitioner has been cancelled and it is the contention of the petitioner that the explanation offered by him before the Licensing Authority has not at all been adverted to. We do not find such statement to be correct. Nonetheless, we are of the view that the petitioner ought to get an opportunity of challenging the order passed by the Licensing Officer.

Patna High Court CWJC No.2085 of 2022 dt.23-03-2022 2/2 Should he prefer an appeal before the appellate authority within a period of thirty days, it shall be taken up for hearing and after affording opportunity to him and other stake holder, if deemed necessary, an order shall be passed within a further period of sixty days, giving reasons for either sustaining or revoking the order of suspension. The order so passed shall be communicated to the petitioner forthwith.

Petition stands disposed of accordingly.
