====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 25-05-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 447, 504, 506/34 of the Indian Penal Code and Sections 25(1-b)a, 26 and 27 of the Arms Act.
Learned counsel for the petitioner submits that petitioner has antecedent of two cases.
The informant alleges that the accused persons including the petitioner came and Bijo Yadav @ Bijay Yadav and Jeetu Yadav @ Jitendra Yadav started indiscriminate firing creating havoc in the locality which the informant witnessed from a key whole of his house. It is further alleged that the said occurrence was committed by them for the reason that they were in doubt that Vijay Prasad had informed the police about them
Patna High Court CR. MISC. No.13231 of 2023(2) dt.25-05-2023 2/2 that they indulged in liquor trade based on which the police had raided their premises.
Learned counsel for the petitioner submits that from perusal of the FIR, it would manifest that no specific allegation is alleged against the petitioner and as far as allegation of firing is concerned i.e. against Bijo Yadav @ Bijay Yadav and Jeetu Yadav @ Jitendra Yadav.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Giriyak P.S. Case No. 493 of 2022, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
