In this case, a show cause has been filed whereby it has been brought to the notice of this Court that in terms of the order of this Court, the Block Development Officer, Baheri, Darbhang has passed an order.

Counsel for the petitioner submits that there is a factual error in the order as Ajay Kumar Rai, Mukesh Kumar Rai and Shambhu Prasad Singh has wrongly been given weightage 22, 19 and 15 respectively whereas the earlier order, different weightage has been given. He submits that the present order cannot be treated to be compliance of the order passed by this Court.

The counsel for the petitioner further submits that

Patna High Court MJC No.3402 of 2014 (2) dt.06-04-2016 2/2 without taking into consideration the earlier order he has passed a different order which is completely illegal. This Court in contempt proceeding cannot examine the merit of the order.

In such view of the matter, this Court does not find purpose to proceed with the matter anymore. Accordingly, the present application is dismissed. However, the petitioner is at liberty he may challenge the order before the appropriate forum, if so advised.
