JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Explosive substance is said to have been recovered from the house of the petitioner. The contention on behalf of the petitioner is that petitioner is in jail custody for more than one year and the seizure list witness has already been declared hostile. Regard being had to the facts and circumstances of the case and also taking note of this fact that the trial of the petitioner is going in full swing, I am not inclined to grant privilege of bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with session trial no. 824 of 2014 arising out of Paroo P.S.Case No. 11 of 2014, pending in the court of learned 10th Additional Sessions Judge, Muzaffarpur stands rejected.
