JUSTICE MOHIT KUMAR SHAH ORAL ORDER 18-03-2023 The present writ petition has been filed for removal of encroachment from the gairmazarua aam land in question, appertaining to Khata No.139, Plot No.1260, situated at Mauza, Anchal Haspura, District-Aurangabad.

The learned counsel for the parties have submitted that the final order has already been passed by the Circle Officer, Haspura, on 20.12.2022, in connection with Encroachment Case No.15 of 2013-14, and it has been found that the

Patna High Court CWJC No.1444 of 2023(2) dt.18-03-2023 2/2 land in question is a public land, hence, it has been directed that the encroachment in question be removed, forthwith.

Having regard to the facts and circumstances of the case, I deem it fit and proper to direct the District Magistrate, Aurangabad to ensure compliance of the aforesaid order dated 20.12.2022, in accordance with law, by taking appropriate action within a period of four weeks of receipt/production of a copy of this order.

The writ petition stands disposed off on the aforesaid terms.
