2. Petitioners apprehend arrest in a case registered for the offence punishable under Section 30 (a)(c) of the Bihar Prohibition and Excise Amendment Act, 2018.

3. It is alleged that 50 liters of illicit country made mahua liquor, 3 H.P gas cylinder, 3 clay stove, salons tablets 10 kg Instant Yeast 3 kg were recovered from road side.

4. It is submitted that the petitioners are innocent and have been falsely implicated in this case. Recovery has been made from an open place. No incriminating material has been recovered from the conscious possession of the petitioners and

Patna High Court CR. MISC. No.5970 of 2025(2) dt.25-02-2025 2/2 they are no way connected with the aforesaid recovery. Petitioner no. 1 claims clean antecedent while petitioner no. 2 have antecedent of one criminal case of similar nature.

5. Learned counsel for the State opposes the bail petition.

6. Considering the facts of the case, clean antecedent of the petitioners, in the event of arrest/surrender within eight weeks from today, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Session Judge VII-cum-Special Judge Excise II, Madhepura in connection with Chousa (Fulot) P.S. Case No. 304 of 2024, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
