The petitioner seeks bail in a case under Section 366(A)/ 34 of the Indian Penal Code.

The informant alleged that Kamal Kumar and Tulsi Kumar were found roaming around his house at 12 in the night. At 12.30 the informant found his grand daughter, Anjali Bharti, missing. Kamal Kumar and Tulsi Kumar kidnapped his grand daughter. The informant alleged that Tulsi Kumar, Kailash Kumar, the petitioner, and mother of Kamal Kumar also helped in kidnapping of his grand daughter.

The petitioner is brother of Kamal Kumar. The informant is not eye witness of the occurrence and the grand daughter of informant was in love with Kamal Kumar and she

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in Banka (Barahat) P.S.
