The petitioner has renewed her prayer for anticipatory bail in a case registered for the offences punishable under Section 365 of the Indian Penal Code.

The husband of the informant went missing on 29.09.2013. Subsequently the informant received a telephone call from one Aslam, the husband of the petitioner, that he claiming himself to be friend of the husband of the

Patna High Court Cr.Misc. No.38149 of 2015 (2) dt.18-09-2015 2/3 informant when he asked to execute a sale deed in his favour only then the husband of the informant will be released. It is submitted by learned counsel for the petitioner that the husband of the informant took rupees seven lakhs from the husband of the petitioner when he agreed to transfer his house in favour of the husband of the petitioner but he did not transfer his house and due to said dispute the accusation has been levelled and considering the entire material collected during investigation the husband of the petitioner has been granted regular bail vide B.P. No. 207 of 2015 by the learned court below and on that ground the prayer for anticipatory bail has been renewed by the petitioner.

This Court is not inclined to revise the earlier order passed by a Co-ordinate Bench of this Court (now Retired). Let the learned court below consider the prayer for regular bail of the petitioner keeping in view of the fact that the husband of the petitioner, against whom there was graver charge, has been granted regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Laheri P.S. Case No. 264 of 2013 pending in the court of learned Chief Judicial Magistrate, Nalanda at Biharsharif.
