JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-09-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. It would appear from perusal of the first information report as well as impugned order that none has seen the actual killing of the deceased. Although, it is apparent from perusal of the impugned order that doctor opined the cause of death of the deceased as asphyxia due to throttling of neck but there is nothing on the record to show who committed the murder of the deceased. Petitioner no. 1 happens to be younger brother in law whereas petitioner no. 2 is Bahnoi of the deceased. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released
