Petitioner is in custody in connection with Harsidhi P.S. Case No. 401 of 2018 for the offence under sections 363, 365,34 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is Dewar of the informant. He has no criminal antecedent.

Referring to the prosecution case, he submits that the informant has levelled allegation of kidnapping of her daughter against this petitioner.

Referring to Annexure-2 he submits that earlier husband of the informant has made complaint at Jalandhar. In that case, allegation was levelled against one Ajay @ Chhotu

Patna High Court Cr.Misc. No.6531 of 2019(2) dt.05-02-2019 2/2 that he took his daughter somewhere else for the purpose of marriage.

Considering the fact that petitioner is close relative of the informant and he has no criminal antecedent, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari in connection with Harsidhi P.S. Case No. 401 of 2018.
