The petitioner is languishing in custody for the offences punishable under Section 366(A)/34 of the I.P.C. and Section 4 of POCSO Act.

Seven persons including the petitioner allegedly kidnapped to the minor daughter of the informant with intent to get her married with co-accused Digvijay.

The report of the S.P. of the district regarding nonrecovery of the victim as yet would reveal that location of the victim and Digvijay has been found at Kolkata and the police is taking all step for early recovery of the victim. Submission is that this is a case of love affairs

Patna High Court CR. MISC. No.17085 of 2021(3) dt.04-10-2021 2/2 between Digvijay and the victim girl. The petitioner is victim of false implication. Petitioner is in custody since 25.11.2020. Considering the nature of material available and completion of investigation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Tariyani Chhapra P.S. Case No. 58 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
