The petitioner seeks bail in a case under Section 399, 402 of the Indian Penal Code and under different section of the Arms Act.

The police intercepted the petitioner and one Md. Guddu and from the possession of petitioner one country made pistol was recovered.

It is submitted that Md. Guddu has already been enlarged on bail vide order passed in Cr. Misc. No. 32000 of 2015 and the petitioner is in jail since 03.04.2015 and he has got no criminal antecedent. The petitioner has already remained in jail for about 5 months.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner

Patna High Court Cr.Misc. No.36709 of 2015 (2) dt.25-08-2015 2/2 is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in Town P.S.
