2. Petitioners seeks bail who are in custody since 04.12.2025 in connection with Vidyapatinagar P.S. Case No. 169 of 2025, F.I.R. dated 10.11.2025 for the offences punishable under Section 310(2) of the BNS, 2023.
3. According to prosecution case, five unknown miscreants intercepted the informant who was in his truck and on the point of gun they took his vehicle, mobile and some cash and fled away.
4. Learned counsel for the petitioners submits that
Patna High Court CR. MISC. No.6495 of 2026(3) dt.23-03-2026 2/3 petitioners have clean antecedent and they have falsely been implicated in the present case. The petitioners are not named in the FIR and their names have been transpired during investigation on the basis of tower location which was recorded in paragraph no. 38 of the case diary. Thereafter, the petitioners have confessed their guilt which was recorded in paragraph no. 47 of the case diary. Except the aforesaid, no other material has come during investigation which suggest the involvement of the petitioners in the present occurrence. No incriminating article has been recovered from the possession of the petitioners and till date no TIP has been conducted by the prosecution. He further submits that the police after investigation submitted the charge sheet against the petitioners. The petitioners are in custody since 04.12.2025.
5. Learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioners.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Dalsinghsarai, Samastipur in connection with Vidyapatinagar P.S. Case No.
Patna High Court CR. MISC. No.6495 of 2026(3) dt.23-03-2026 3/3 169 of 2025, subject to the following conditions:- i. Petitioners shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the court and on their absence on two consecutive dates without sufficient reason, their bail bond shall be cancelled by the Court below. ii. If the petitioners tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
iii. And further condition that the court below shall verify the criminal antecedent of the petitioners and in case at any stage it is found that the petitioners have concealed their criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioners. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
