The petitioner seeks bail in a case registered for the offences punishable under Sections 406, 409, 420 and 34 of the Indian Penal Code and under Section 7 of the E.C. Act. The paddy was kept in the godown of Krishnadeo Azad @ Krishnadeo Yadav and it was found that 4707.60 quintals of paddy was missing. The godown incharge is alleged to have misappropriated the entire amount with the help of Agricultural Advisor and the Block Supply Officer.

It is submitted that the petitioner was not incharge of the godown. He was to keep vigil on the godown of Krishnadeo Azad @ Krishnadeo Yadav. The godown incharge or the godown

Patna High Court Cr.Misc. No.43080 of 2015 (2) dt.18-09-2015 2/2 manager have already been enlarged on bail vide orders passed in Cr. Misc. No. 41344 of 2014. The case of the petitioner stands on better footing than that of Krishnadeo Azad @ Krishnadeo Yadav. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Muzaffarpur in Motipur P.S.
