The petitioner apprehends his arrest in connection with Araria P.S. Case No.783 of 2021, registered for the offences punishable under Sections 419, 420, 467, 468, 471 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioners have got no criminal antecedent as stated in paragraph-3 of the bail application. It is submitted that no overt act is alleged against the petitioner. No material has come in the case diary against the petitioner. It is submitted that the only allegation against the petitioner is that he was present in the bank when the account was being opened by Anufan @ Alfun Khatoon.

Patna High Court CR. MISC. No.8043 of 2022(3) dt.06-09-2022 2/2 Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.

However, if petitioner surrenders before the learned court below within a period of six weeks from today and prays for regular bail, the learned court below shall consider the prayer for regular bail of the petitioner preferably on the same day without being prejudiced by this order.
