The name of petitioner came in this case in course of investigation , but admittedly, when police submitted first charge sheet the petitioner was not charge sheeted and subsequently, he was charge sheeted in the supplementary charge sheet. Moreover, even if the theory of police is assumed to be true, it is only said to be a case of last seen.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-V, Madhubani in connection with session trial no. 126 of 2015 arising out of Bisfi P.S.Case No. 170 of 2007.
