The petitioner has preferred this application for grant of regular bail in a case registered against four unknown under section 392 of the Indian Penal Code.
As per allegation in the FIR, four accused persons on two motorcycles, on the point of pistol looted the informant of the bag containing cash besides other articles mentioned in the FIR.
It is submitted by learned counsel for the petitioner that the FIR was registered against unknown. On the basis of confessional statement of the petitioner himself, he has been falsely implicated in the instant case. No incriminating article
Patna High Court CR. MISC. No.4991 of 2020(4) dt.09-08-2021 2/2 has been recovered from his possession nor has he been put on T.I. parade. He is in custody since 19.6.2019. Heard learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner together with the petitioner having remained in custody for over 2 years, the Court directs the petitioner to be enlarged on bail in connection with Bounsi P.S. Case no. 260 of 2018 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Banka.
