Petitioner is in custody in connection with Katoria P.S. Case No. 15 of 2019 for the offence under sections 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner was not named in the FIR. He is in custody since 20.8.2019 yet he has not been put on TIP.

Learned counsel further submits that nothing was recovered from the possession of the petitioner and except for criminal antecedent there is no material against this petitioner to connect in the commission of offence.

Considering the fact that petitioner was not named in the FIR and he has remained in custody for more than nine

No.5899 of 2020(4) dt.28-05-2020 2/2 months, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Katoria P.S. Case No. 15 of 2019.
