2 The petitioners seek regular bail in a case registered for the offence punishable under Sections 126 (2), 115 (2), 127 (2), 352, 351 (2), 70 (1) of the BNS.

3 The prosecution case, in short, is that all the three petitioners have committed rape with the informant. 4 Learned counsel for the petitioners submits that during the course of trial, the victim and her husband both have been examined as PW 1 and PW 2 respectively. The victim herself has stated in her examination-in-chief that she does not identify the petitioners as the accused persons have masked their

Likewise, her husband has also stated that he does not identify any of the petitioners. It is also submitted that the petitioners are in custody since 30.04.2025 having clean antecedent.

5 Learned APP appearing for the State has vehemently opposed the prayer for bail.

6 Considering the aforesaid facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioners are directed to be released on bail on each of them furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Rape and POCSO Act, Patna in Shahpur PS Case No 188 of 2025.
