JUSTICE SUDHIR SINGH ORAL ORDER 26-11-2015 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted under Sections 302/34 of the Indian Penal Code.

Allegation against the petitioners is to have assaulted brother of the informant, who died during the course of treatment. It has been submitted on behalf of the petitioners that petitioner nos. 1 to 5 are in custody since 24.6.2015 and petitioner no. 6 is in custody since 16.6.2015. They have got no criminal antecedent. Chargesheet has been submitted in the present case. There is no allegation of tampering of evidence against the petitioners. General and omnibus allegation has been made. No specific injury has been attributed against the petitioners. The main allegation is against one Lorik Ram.

On behalf of the State, it is submitted that petitioners are

Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Bagaha, West Champaran, in connection with Bagaha P.S. Case no. 164 of 2015.
