The petitioner is in custody in a case registered under Section 302 of the Indian Penal Code.
The allegation against the petitioner is of killing the sister of the informant by burning her body. It has been submitted on behalf of the petitioner that the petitioner is in custody since 29.1.2015. Charge sheet has been submitted in this case. The petitioner has got no criminal antecedent. There is no allegation of tampering with the evidence against the petitioner. From perusal of paras 9 and 10 of the case diary it appears that the petitioner is a handicapped person and the deceased had an accidental death. This said fact is supported by
Patna High Court Cr.Misc. No.38604 of 2015 (3) dt.08-10-2015 2/2 the brother of the deceased. It is further submitted that the alleged incident has taken place after fifteen years of the marriage. On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,Kaimur (Bhabua) in Bhabua P.S.Case No.313 of 2014.
