The petitioner seeks bail in a case registered under Sections 25(1-B)a,, 26 of Arms Act and 37(a) of Bihar Prohibition and Excise Act, 2018.
Allegation against the petitioner is that having pistol in his hand, he was threatening the people in drunken state. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 22-11-2018. Charge sheet in this case has already been submitted. Allegedly, a country-made pistol along with two live cartridges were recovered from possession of the petitioner. No liquor was
Patna High Court CR. MISC. No.9465 of 2019(7) dt.10-04-2019 2/2 recovered. The petitioner is alleged to have misbehaved in drunken state. There is no breath analyzer test report to show that the petitioner was in drunken state.
On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, (Excise), Lakhisarai connection with Lakhisarai P.S.
