The petitioner seeks bail in a case registered for the offences punishable under Sections 364, 368, 377 and other Sections of the Indian Penal Code.
Babban Kumar Rai, Lalu Besra the petitioner, Ashok Das are alleged to have kidnapped the victim and committed unnatural sex with him.
It is submitted that the victim returned on the next day. The doctor examined the victim, but did not find any sign of unnatural sex. Similarly situated co-accused Ashok Das and Babban Kumar Rai have already been enlarged on bail vide orders passed in Cr. Misc. No. 43863 of 2014 and Cr. Misc. No. 5856 of
Patna High Court Cr.Misc. No.37520 of 2015 (2) dt.26-08-2015 2/2 2015 respectively. The case of the petitioner stands exactly on the same footing.
Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Lalan Kumar, the learned Judicial Magistrate, Ist Class Jamui, in Chakai P.S.
