The petitioners seek bail in anticipation of their arrest in connection with Chiraiya P. S. Case No. 393 of 2018 (G.R. No. 1420/18), dated 29.10.2018 instituted for the offences under Sections 341, 323, 324, 307, 504, 506 and 447/34 of the Indian Penal Code.
The petitioners are alleged to have assaulted the son of the informant and others.
Learned counsel for the petitioners has submitted
Patna High Court Cr.Misc. No.6872 of 2019(2) dt.06-02-2019 2/3 that there is a counter version of the occurrence lodged by co-accused / Anil Kumar Singh.
The petitioner no. 2 is said to be physically disabled by 55 per cent. There is pending land dispute between the parties and in the past there had been a panchayati with respect to such dispute, but it did not yield any result. The nature of injury suffered by the son of the informant has been kept reserved but has been opined to have been caused by a hard and blunt substance. Regard being had to the aforesaid facts as also taking into account the clean antecedents of the petitioners and pending land dispute between the parties, the petitioners, above-named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Sikarhana at Dhaka, District - East Champaran in connection with Chiraiya P. S.
