Mr. Pawan Kumar Chaurasia, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-02-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 80(2), 103, 3(5) of the B.N.S., 2023.

3. It is a case of 'Dowry Death'. It is alleged that sister of the informant was married with co-accused Arun Kumar on 28.04.2015 and after the marriage, when sister of informant went to her Sasural, all the accused persons named in the F.I.R. including petitioner subjected her to cruelty and harassment for additional demand of dowry and due to nonfulfillment of same, on 22.07.2024, they killed sister of informant and disappeared her dead-body. On search, the deadbody of sister of informant was found in a bush.

4. Learned counsel for the petitioner submits that informant is not eye-witness to the occurrence and only on suspicion, petitioner and others have been made accused. Petitioner is distant Gotiya of husband of the deceased and has got no concern with the alleged occurrence. Petitioner is separate in mess and property. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail of petitioners.

6. However, considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 215 of 2024, subject to condition as laid down under Section 482 of B.N.S.S., 2023.
