Petitioner seeks bail in Minapur P.S. Case No.319 of 2018 instituted for the offence under Section(s) 366, 376-D Indian Penal Code and Section 5/6 of the POCSO Act. Counsel for the petitioner submits that victim girl has given statement under Section 164Cr.P.C., wherein, she has levelled specific allegation against co-accused, Shamshad and Khurshid, of having established physical relationship with her. Such statement has been made by the petitioner in para 13 of the bail petition. Counsel for the petitioner further submits that there is general and omnibus allegation against the petitioner. Petitioner is in custody since 08.08.2018 having clean antecedents.

Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, POCSO, Muzaffarpur, in connection with Minapur P.S. Case No.319 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
