The petitioner seeks bail in Chandan (Anandpur) P.S. Case No. 107/2014, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code. The son of the deceased made allegation that Ashish Yadav and Mohan Yadav tied his father Bhuneshwar Yadav and brutally assaulted causing death of his father. The informant himself came on the place of occurrence on alarm. The informant alleged that the petitioner was exhorting Ashish Yadav and Mohan Yadav but no allegation of assault is made.

It is submitted that the petitioner was not present even on the place of occurrence. The petitioner happens to be uncle of the informant and there is dispute in their family for the last 16 years.
