JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 06-06-2022 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner seeks bail in connection with Dariyapur P.S. Case No. 530 of 2021 registered for the offence under Section 392 of the Indian Penal Code. The accused petitioner is not named in the F.I.R. and is in custody since 26.11.2021.
It is alleged that accused/petitioner alongwith other co-accused persons snatched two mobile phones, motorcycle and other valuables of the informant on the point of pistol. Learned counsel appearing on behalf of the accused/petitioner submitted that name of the accused/petitioner has been surfaced on the confessional statement of co-accused, Kush Kumar leading to no recovery. It has further been submitted that petitioner is a man of clean antecedent.
Patna High Court CR. MISC. No.7019 of 2022(2) dt.06-06-2022 2/2 Learned APP appearing on behalf of the State fairly conceded that the name of the accused petitioner has been surfaced on the confessional statement of co-accused Kush Kumar leading to no recovery.
Considering the facts and circumstances as mentioned above and as the name of the accused petitioner has been surfaced on the confessional statement of co-accused, Kush Kumar leading to no recovery, let the petitioner, above named, is directed to be released on bail in connection with Dariyapur P.S. Case No. 530 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-13, Saran at Chapra with the following condition: "That one of the bailors shall be the close relative of the accused/petitioner like mother/father/sister/brother."
