JUSTICE SUDHIR SINGH ORAL ORDER 14-10-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 33, 41 and 42 of the Indian Forest Act, 1927 and 52 of the Bihar Amendment Act, 1989.

Allegation against the petitioner is that he was apprehended while boarded on a Pick-up van which was found loaded with fire woods.

It has been submitted on behalf of the petitioner that he is in custody since 15.6.2015. Chargesheet has been submitted in the case. There is no allegation of tampering of evidence against the petitioner. Petitioner has been made accused due to mistake of fact. He had nothing to do with the alleged wood on the tractor. It is further submitted that petitioner is ready to deposit an amount of Rs.5,000/- in the court below which shall be subject to the final disposal of the case.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Forest Case no. 83 of 2015.
