The petitioner is languishing in custody for the offences punishable under Sections 302/201 of the Indian Penal Code.

The FIR was lodged against unknown on recovery of dead body of the brother of the informant and an unknown female. Murder was committed by throttling and cutting with sharp cutting weapon. The petitioner has got no criminal antecedent and he is in custody since 13.07.2018. During investigation no direct material came against the petitioner save and except his confession before the police after arrest. Considering the aforesaid fact, let the petitioner,

Patna High Court CR. MISC. No.9699 of 2019(3) dt.30-04-2019 2/2 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with S.T. No.245 of 2018, arising out of Bhabua (Sonhan) P.S. Case No.319 of 2018, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below having immovable property in his name.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
