JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 04.08.2013 in a case registered for the offences punishable under Section 366/34 of the Indian Penal Code.

It is alleged that the petitioner, Mukti Mahto and Kanhi Mahto kidnapped the wife of the informant. The petitioner was seen escaping with the wife of the informant from the cane field when his mobile fell down which was seized by the informant and given to the police.

It is submitted by learned counsel for the petitioner that for the occurrence of 01.07.2013, the FIR was lodged on 17.07.2013 and the mobile of the petitioner was taken by the informant. Other accused against whom the accusation has been levelled, has been granted bail vide Cr. Misc. No. 1702 of 2014. A

Patna High Court Cr.Misc. No.36895 of 2014 (3) dt.30-01-2015 2/2 statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

It is submitted by learned counsel for the State that the victim has not been traced as yet.

Considering the delayed lodging of the case, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Adhoc Addl. District and Sessions Judge-IV, Bettiah, West Champaran in connection with Sanichari (Yogapatti) P.S. Case No. 178 of 2013. (Dinesh Kumar Singh, J) Amrendra/- U T
