JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-04-2019 This is an application for grant of anticipatory bail in connection with Hajipur Sadar P.S. Case No. 579 of 2018, disclosing offences under Sections 328, 379, 120(B) of the Indian Penal Code.

Allegation against the petitioner is that he had informed to send the staff of the informant to the Royal Fashion Cloth Shop along with the camera, thereafter two staffs of the informant had gone with the camera worth Rs.1,40,000/- and at 6 pm, one person namely Pappu had informed the informant that his both staffs are unconscious and then they told him that they had eaten sweets, banana, samosa in Royal Fashion Cloth Shop and thereafter the informant believed that the petitioner in collision with the owner of the Royal Fashion Shop has committed the same.

No.6597 of 2019(4) dt.05-04-2019 2/2 Submission of learned counsel for the petitioner is that except that he has asked the informant to send his staffs with camera to the Royal Fashion Cloth Shop, absolutely nothing against the petitioner and the staffs of the informant were found unconscious in the Royal Fashion Shop and the petitioner has no criminal antecedent.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur, in connection with Hajipur Sadar P.S. Case No. 579 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Amjad/- U T
