Having regard to the nature of allegation against the petitioners for the offences punishable under Sections-341, 323, 504, 379 and 354 of the Indian Penal Code and Section-3(i) (x) of the S.C./S.T. (Prevention of Atrocities) Act, 1989, this Court having found that the petitioners were already released on police bail on 02.01.2014 by executing an undertaking, this Court would not find the petitioners entitled for privilege of anticipatory bail.
That being so, the prayer for anticipatory bail of the petitioners is hereby rejected.
If the petitioners would surrender within a period
Patna High Court Cr.Misc. No.37174 of 2014 (2) dt.27-02-2015 of four weeks from today before the Court below their prayer for regular bail shall be considered and disposed of in the light of the judgment of this court in the case of Mahendra Prasad Singh vs the State of Bihar reported in 2004(3) PLJR 491.
