1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Barhara P.S. Case no. 73 of 2025 registered under sections 115(2), 109(1), 351(2), 352 and 3(5) of the Bhartiya Nyay Sanhita, 2023.

3. As per the prosecution case, the informant states that while she was asleep, the petitioner and one Diwakar Singh entered in her house with wrong intentions. It is further stated that on resistance by the informant, the petitioner is said to have assaulted with an iron rod on the head of the informant causing serious injuries.

4. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. They are gotias and the dispute was trivial over partition of wheat

Patna High Court CR. MISC. No.10053 of 2026(2) dt.25-02-2026 2/2 crop. There is case and counter case between the parties, a copy of the F.I.R. of the counter case has been brought on record as Annexure-P/2 to the petition. Learned counsel further referring to the injury report submits that the injury on the informant has been found to be simple in nature. The petitioner is in custody since 20.11.2025 and charge sheet has been submitted in the case.

5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the submissions made by learned counsel for the petitioner as stated herein above and the petitioner having remained in custody since 20.11.2025, the Court directs the petitioner to be enlarged on bail in connection with Barhara P.S. Case no. 73 of 2025 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara.
