The petitioner prays for grant of bail in Bhangaha P.S. case no.66/2017 ( Tr. no. 39/2021) registered for the offence punishable under sections 20(c ), 22, 23 of the NDPS Act. As per prosecution case, 14 packets narcotics weighing 18 kg and Nepali currency were recovered from possession of the petitioner.

It is submitted on behalf of petitioner that petitioner is innocent and has been falsely implicated in this case by the police. Nothing has been recovered from the possession of the petitioner and he has clean antecedent and is in custody since 11.12.2017.

Learned counsel for the State opposed the prayer for

Patna High Court CR. MISC. No.6838 of 2022(3) dt.19-05-2022 2/2 bail and submitted that huge quantity of narcotic substance has been recovered from the possession of the petitioner. Considering the quantity of recovery and gravity of offence, prayer for bail of the petitioner is rejected. (Prabhat Kumar Singh, J) s.hassan/- U T
