2. Heard learned counsel appearing on behalf of the parties.

3. The petitioner seeks bail in a case registered for the offence under Sections 393 and 398 of the Indian Penal Code and Section 27 of the Arms Act.

4. As per the prosecution case, the petitioner along with two other co-accused persons attempted to rob the informant and his wife on gunpoint. When two local boys interfered, the accused persons fired them and fled away on their motorcycle. 5.

He next submits that the name of the petitioner has transpired by confessional statement of co-accused Mohan Kumar who has been granted bail by this Court passed in Cr. Misc. No. 17721 of 2022 and petitioner is in custody since 10.10.2023. 6.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 7.

Considering the facts and circumstances of the case, let the petitioner, above named, be directed to be released on bail after framing of the charge in connection with Athmalgola P.S. Case No.149 of 2021 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-III, Barh, Patna with condition that petitioner is directed to remain physically present before the learned trial court on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner will liable to be cancelled.
