JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-01-2015 Petitioner is languishing in custody since 26.06.2014 in a case registered for the offences punishable under Sections 376, 493, 120B of the I.P.C.

It is alleged that petitioner being brother-inlaw(Dewar) of the sister of the informant pressurized the informant for marriage, married with her and established physical relationship but subsequently started torture and demand of dowry. On fear of her life the informant went to her relative's house.

It is submitted by learned counsel for the petitioner that elder sister of the informant is married with the brother of the petitioner and she has sworn affidavit to the effect that marriage was performed with consent of the parties. Hence, even assuming the accusation no case under Sections 376, 493 of the I.P.C is made out. The doctor has assessed the

Considering the nature of accusation and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Madhubani Town P.S.
