The petitioner is languishing in custody for the offences punishable under Sections 341/323/447/307/504/34 of the Indian Penal Code. Later on offence under Section 302 of the Indian Penal Code was added.

The petitioner and six others assaulted to the father of the informant as a result whereof he died after two days of the occurrence. The doctor has found abrasion at the shoulder and left knee joint as well as abrasion at the right knee. Blood clots in the left side of temporal region and haematoma at left parietal side. Head injury was cause of death which was result of some force impact.

Patna High Court CR. MISC. No.6823 of 2019(3) dt.18-04-2019 2/2 Submission is that there is no other eyewitness of the occurrence nor there is specific allegation against the petitioner. The petitioner is in custody since 06.09.2018. Investigation of the case is complete.

The nature of allegation does not show that the petitioner had knowledge or any intention to commit murder. Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Goraul P.S. Case No.139 of 2017, with condition that petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
