Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 30(a)of Bihar Prohibition and Excise Act, 2018.

Since the petitioner carries criminal antecedent under Bihar Prohibition and Excise Act and in the present case also allegation is under Bihar Prohibition and Excise Act, in my view, this is not a fit case for grant of anticipatory bail to the petitioner in connection with Taraiya P.S.Case No.192 of 2019 pending in the court of learned Additional Sessions Judge 2nd

Patna High Court CR. MISC. No.16758 of 2021(2) dt.23-11-2021 2/2 -cum-Special Judge, Excise Act, Saran at Chapra. Hence, prayer is refused.

Petitioner is directed to surrender within two weeks and pray for regular bail.
