JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-02-2019 This is an application for grant of anticipatory bail in connection with Nabinagar P.S. Case No. 332 of 2018, disclosing offences under Sections 406 and 420 of the Indian Penal Code.
Allegation against the petitioners, who are the employees of M/s. Quess Corporation Ltd., is of embezzlement of Rs.4,56,844/-.
Submission of learned counsel for the petitioners is that due to the fault in Excel Software of the said company, Rs.4,56,844/- has wrongly been mentioned in place of
Patna High Court Cr.Misc. No.9697 of 2019(2) dt.19-02-2019 2/2 Rs.80206/- was pending with M/s. Quess Corporation Ltd. and later on certificate was issued by the concerned authority to the effect that there is no amount due with the petitioner. Heard learned A.P.P. also.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad, in connection with Nabinagar P.S. Case No. 332 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. This is further subject to the condition to cooperate in investigation of the case and produce all the papers before the Investigating Officer.
