The petitioner seeks bail in Bettiah Muffasil (Banuchappar) P.S. Case No. 547/2014, registered for the offences punishable under Sections 302 and other Sections of the Indian Penal Code. The informant alleged that the dead body of his brother Chunnu Kumar was found in a cremation ground. The informant suspected the names of Madan Ram, Akhilesh Ram, Pramod Ram (petitioner), Ranjan Ram and Jitendra Ram that they might have killed his brother.
It is submitted that there is no eye-witness of the occurrence. Only evidence that has come against the petitioner and perhaps that they were last seen with the deceased. Similarly situated co-accused Ranjan Ram has already been granted bail vide order passed in Cr. Misc. No. 25968/2015. The case of the
Patna High Court Cr.Misc. No.37814 of 2015 (2) dt.26-08-2015 2/2 petitioner stands on the same footing as that of Ranjan Ram. Learned counsel for the informant while opposing the prayer for bail submitted that the petitioner was last seen with the deceased.
Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Bettiah Muffasil (Banuchappar) P.S. Case No. 547/2014.
