JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-05-2019 Petitioner seeks regular bail in connection with Sessions Case No.986(B) of 1999 arising out of Bariyarpur (Muffasil) P.S. Case No.122 of 1998 registered for the offences punishable under Sections 147, 148, 149, 307, 302 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation as per F.I.R. against the petitioner and other accused persons is of causing death of Shankar Mandal son of the informant. Petitioner is named in the F.I.R. It further appears that the case is of the year 1998 and the charge sheet has been submitted showing that petitioner is absconder and he did not appear before the Court and the case of the petitioner was separate from the other accused persons and the case of the other accused persons have been committed to the Court of Sessions.

No.18044 of 2019(3) dt.20-05-2019 2/3 Submission of the learned counsel for the petitioner is that due to some misconception he could not appear before the court nor he has informed and he is in custody since 03.08.2017 and the allegation is of member of the mob. No specific allegation has been attributed against this petitioner and considering the same one of the co-accused Shankar Singh has been granted privilege of bail by a Co-ordinate Bench of this Court vide order dated 19.04.2019 in Criminal Misc. No.5434 of 2019. Further submission is that charge has already been framed in this case.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned F.T.C.-II, Munger, in connection with Sessions Case No.986(B) of 1999 arising out of Bariyarpur (Muffasil) P.S. Case No.122 of 1998, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with the condition that he is to cooperate with the disposal of the trial and appear as and
