Petitioner is apprehending arrest in connection with complaint case no. 1097 of 2018 for the offence under sections 498A, 504, 323 of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that allegation against this petitioner is that he meted the informant with cruelty. Learned counsel submits that there is no marriage with this petitioner. In fact, the complainant has wedlock with one Md. Naushad and she has two children out of the wedlock and after divorce from Md. Naushad negotiation for marriage

Patna High Court CR. MISC. No.7054 of 2020(2) dt.28-02-2020 2/2 with the petitioner failed and as a counter blast thereof, the petitioner has been made accused in this case. Considering the aforesaid, the Court is inclined to grant anticipatory bail to the petitioner, let the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Aurangabad, in connection with Complaint Case No. 1097 of 2018 subject to the condition as laid down under section 438(2) of the Cr.P.C.
