The petitioner has prayed for regular bail in a case instituted for the offence under Sections 341, 323, 498A, 504 324 and 34 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.

The allegation against the petitioner along with others is of assaulting/ torturing with the informant for further dowry demand. It is further alleged that the petitioner also made an attempt to administer poison into her mouth forcibly. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this. He has

Patna High Court CR. MISC. No.9638 of 2023(2) dt.03-05-2023 2/2 committed no offence. Petitioner is the husband of the informant. Petitioner is ready to keep his wife with full dignity and honour. Petitioner has got no criminal antecedent as stated in para-3 of the bail petition. He is languishing in judicial custody since 13.11.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bettiah, West Champaran in connection with Majhaulia P.S. Case No. 659 of 2022.

The trial Court is directed to make effort for settling the dispute between the parties.
