Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 414,420,120(B),34 of the Indian Penal Code.

Prayer for anticipatory bail was already refused to the petitioner by a Coordinate Bench of this Court on 09.07.2019 with direction to surrender and pray for regular bail. The said order got finality as the same was not challenged. The petitioner did not comply the said order and waited for retirement of the Hon'ble Judge. This Court was inclined to

Patna High Court CR. MISC. No.16766 of 2021(2) dt.23-11-2021 2/2 dismiss this application with heavy cost. However, learned counsel for the petitioner, after some argument, seeks permission to withdraw this application in connection with Muzaffarpur Sadar P.S.Case No.401 of 2016 pending in the court of learned Judicial Magistrate 1st Class, Muzaffarpur. Hence, it is dismissed as withdrawn.

If the petitioner would not surrender within two weeks, the learned court below shall take coercive steps for apprehension of the petitioner and submit a report to this Court regarding step taken for apprehension of the petitioner. (Birendra Kumar, J) Nitesh/- U T
